You understand and accept that, irrespective of your responsibilities herein, you are entirely responsible for assessing your compliance with all relevant laws and regulations. If you violate any of these limitations, your license will instantly end. BEP-20 also reserves the right, but not the obligation, to review any of your content or activity on this Site or otherwise provided to obtain the Services and to take any appropriate action against you if you violate these Terms or any other applicable laws or regulations as determined by BEP-20 in its sole and absolute discretion.

4. Indemnification

You agree to hold BEP-20, its affiliates, vendors, suppliers, and authorized representatives (the "BEP-20 Affiliates") harmless from and against any and all claims, demands, damages, losses, liabilities, and expenses (including costs and attorneys' fees) arising out of or related to your I use of the Site and/or Services, (ii) violation of these Terms or any applicable laws or regulations, or (iii) information provided by you to BEP-20 or any third-party. BEP-20 retains the right to assume the exclusive defense and control of any matter for which you are obliged to indemnify BEP-20 or the BEP-20 Affiliates at your cost. You undertake not to resolve any dispute without BEP-20's prior written approval.

5. Warranties are expressly disclaimed

The website and the services are provided "as is" and "where is." BEP-20 expressly disclaims and negates all warranties and conditions of any kind, including, but not limited to, implied warranties or conditions of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement of intellectual property or other rights violation. Additionally, BEP-20 makes no warranties or representations about the accuracy, likely results, or reliability of information provided on the site, as part of the services, or any third-party site or service linked to this site.

6. Materials accuracy

There may be technical, typographical, or photographic mistakes in the content on this site. BEP-20 makes no representations or warranties about the accuracy, completeness, or timeliness of any materials or information on the Site or in the Services.

7. Hyperlinks

This Site and/or the Services may include links to third-party sites, such as ads for third-party goods and services. These links are provided only for your convenience. BEP-20 does not evaluate, monitor, recommend, guarantee, or make any representations about the sites connected to this Site or the services provided on them. The rules, terms, and conditions of any such third-party sites govern your engagement with them. Before communicating with such a third party, you are completely responsible for performing any research you see necessary (ies). You use any linked site at your own risk, and BEP-20 is not liable for any loss or damage incurred as a result of your dealings with third parties.

8. Electronic communications

Electronic interactions between you and BEP-20 may include, but are not limited to, e-mails and messages posted on the Site. You agree to receive communications in electronic form and acknowledge that any such communications will fulfill any legal requirements that would otherwise apply if they were communicated in hardcopy printed form.

9. Restrictions

BEP-20 or the BEP-20 Affiliates will not be liable for any damages, including, without limitation, damages for lost data or profits due to business interruption, costs of procuring substitute goods or services, or any indirect, consequential, exemplary, incidental, special, or punitive damages arising out of or related to the use of or inability to use the Site or Services, even if BEP-20 or a BEP-20 Affiliate has been notified orally or in writing of the possibility of such damages. BEP-20's or the BEP-20 Affiliates' liability for any damages arising from or connected to these Terms or your use of or inability to use the Site or Services will at all times be limited to a maximum of US Twenty Dollars ($20.00) to the fullest extent permissible by law. These limits may not apply to you because some countries do not allow limitations on implied warranties or responsibility for consequential or incidental damages.

10. Modifications

BEP-20 reserves the right to change these Terms at any time and without notice. You agree to be bound by the then-current version of these Terms by using this Site and/or the Services.

11. Termination number

BEP-20 maintains the right to suspend or terminate your use of the Site and/or Services at any time and for any reason. Your access to the Site, the Services, your user information, and your user account may all be suspended or terminated at any time without notice. You acknowledge that if your account is suspended or terminated, your user information and account may be permanently deleted from BEP-20's systems and databases. You agree that you will not hold BEP-20, its officers, directors, partners, consultants, or affiliates accountable for any such suspension or termination, or any consequent loss of information, as a condition of using the Site and/or the Services.

12. Additional services - information on your credit profile

If you request that BEP-20 obtain your personal credit profile through the Site or Services, you understand that by clicking the "I Accept" button, you are giving BEP-20 "written instructions" authorizing BEP-20 to obtain information from your personal credit profile (the "Information") from TransUnion, Equifax, Experian, and/or other credit reporting agencies (each a "Bureau" and collectively, the "Bureaus"). BEP-20 has your permission to gather this information just to verify your identity and to present it to you. BEP-20 is not a credit reporting agency, and it has no control over the information supplied to you by the Bureau(s). All information is provided "as is" and "where is," with no promise of completeness or accuracy. BEP-20, its affiliates, agents, and employees are not accountable to you or anyone else who makes a decision or takes action based on the Information. If you feel the information collected from a Bureau(s) is incorrect, please contact TransUnion at https://www.transunion.com/credit-disputes/dispute-your-credit.

13. Release number

You hereby release and forever discharge BEP-20 (including its officers, directors, employees, agents, successors and assigns) and the BEP-20 Affiliates from, and hereby waive and relinquish, all past, present, and future claims, disputes, controversies, demands, rights, obligations, liabilities, actions and causes of action of any kind and nature that have arisen or arise directly or indirectly out of or that relate directly or indirectly to the Site, the Services, your Submitted Content, and your Submitted Content, and any

14. Governing law

These terms and conditions are regulated by and interpreted in accordance with Florida law, and you irrevocably submit to the exclusive jurisdiction of the courts of that State or place.

15. Class action waiver and dispute resolution

You are hereby waiving your constitutional and statutory rights to go to court and have a trial in front of a judge or a jury, opting instead for binding arbitration to settle any claims and disputes. All claims and disputes within the scope of this arbitration agreement must be arbitrated or litigated individually, not in class, and claims of more than one customer or user cannot be arbitrated or litigated jointly or consolidated with those of any other customer or user. The arbitrator's award and compliance with it, as well as all other details of the arbitration procedure, must be kept totally secret. Unless otherwise required by law, you agree to preserve confidentiality. This paragraph does not preclude you or BEP-20 from sending any information required to enforce these Terms, enforce an arbitration judgment, or seek injunctive or equitable relief to a court of law. Regardless of the preceding, any party may seek emergency equitable relief in a state or federal court to maintain the status quo awaiting arbitration. A request for interim measures will not be construed as a renunciation of any of the Arbitration Agreement's other rights or responsibilities.

16. Complete terms

These Terms are the complete agreement between you and BEP-20 concerning your use of the Site and/or Services. The omission of BEP-20 to exert or enforce any right or term of these Terms does not constitute a waiver of such right or provision. If any term of these Terms is found to be illegal or unenforceable for any reason, the other sections of these Terms will remain in effect, and the invalid or unenforceable provision will be considered changed to the fullest extent permissible by law. You may not assign, subcontract, delegate, or otherwise transfer these Terms or your rights and responsibilities hereunder without BEP-20's prior written agreement, and any attempted assignment, subcontract, delegation, or transfer in violation of the above will be null and invalid. BEP-20 is free to assign these Terms as he sees fit. Assignees are bound by the terms and conditions set forth in these Terms.
